East Coast FM is owned and operated by East Coast FM (SCIO), which is a not-for-profit company limited by guarantee without a share capital, registered in Scotland. Its studios are based in Haddington, East Lothian, from where all of its programming is broadcast and the vast majority originates. For more information, please visit our public file.

East Coast FM (SCIO), utilising the support and services of its affiliates and partners, aims to sustain and operate a radio station called East Coast FM, which broadcasts under a community radio licence to the East Lothian region on 107.6 FM, and online via its website. The company’s remit is to operate the station to meet its social gain objectives as laid out by Ofcom under the Community Radio Order 2004, as well as other community-focused commitments and obligations under the terms of its broadcasting licence. The station was awarded a licence in 2013 and had its licence renewed in 2018, allowing it to broadcast until 2023.

East Coast FM (SCIO) takes all complaints very seriously. If you have a complaint about anything you have heard on-air, please email us at: info@eastcoastfm.co.uk.

Please note that for us to respond to your formal complaint, you must include your full name and a valid e-mail address. Complaints submitted via post must include your full name and postal address. We aim to investigate and respond to all formal complaints within 28 days.

  1. WEBSITE

ACCESS

Your access to and use of www.eastcoastfm.co.uk (”the Website”) is subject exclusively to these Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website.

CONTENTS

The contents of the Website do not constitute advice and should not be relied upon in making or refraining from making, any decision.

East Coast FM (SCIO) reserves the right to:

  1. i) change or remove (temporarily or permanently) the website or any part of it without notice and you confirm that www.eastcoastfm.co.uk shall not be liable to you for any such change or removal; and
  2. ii) change these Terms and Conditions at any time, and your continued use of the Website following any changes shall be deemed to be your acceptance of such change.

The Website may include links to third party websites that are controlled and maintained by others. Some online services, such as audio streaming, are provided by third party suppliers and while we seek to keep such services operational, at times this may not be under our control. Any link to other websites or third party service is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites or services.

  1. i) All copyright, trade marks and all other intellectual property rights in the Website and its content (including without limitation the website design, text, graphics and all software and source codes connected with the website) are owned by or licensed to www.eastcoastfm.co.uk or otherwise used by www.eastcoastfm.co.uk as permitted by law.
  2. ii) By supplying any images, video or creative to East Coast FM (SCIO) you are responsible for having gained appropriate permissions or are the authorizer of use of copyrighted material. Any material found to be in breach of copyright will be removed from the website. East Coast FM (SCIO) will not be responsible for any supplied images being in breach or copyright – it will lie with the supplier of said materials.

iii) In accessing the website you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the Website for personal, non-commercial home use only.

DISCLAIMERS AND LIMITATION OF LIABILITY

INDEMNITY

You agree to indemnify and hold www.eastcoastfm.co.uk and its employees/volunteers and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against East Coast FM (SCIO) arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.

SEVERANCE

If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be.

  1. LISTEN LIVE

You can listen live to East Coast FM via our online stream by clicking the Listen Now button on our website home page. This will open another page and thereby clicking Listen Now cause a pop-up window to open. Some browsers block pop-ups, so please adjust your settings accordingly if you cannot open the Listen Live player.

For ease of use, we stream via Canstream. This is the standard for almost all community radio stations across the UK and gives you one consistent player that you can use to store favourite stations, search for new ones and much more. For more information on Canstream, please see their FAQ page.

Our default online stream runs in stereo MP3 format at 128kbps. You will need a broadband connection to be able to listen to this stream. If you listen to the stream on a mobile device, you can also make use of a mobile stream which is a lower bit-rate to avoid using as much mobile data. The easiest way to ensure you’re using this stream is to tune in through our mobile app (available on iOS and Android, for free) where it will be selected by default. If you are using the app on some tablets it’s advised that you check the stream that’s being used – some tablets default to the full quality stream. Other providers may make this stream available to you – this will be at their discretion.

  1. DATA PROTECTION

Information you provide when you contact East Coast FM, is only used by East Coast FM and is not distributed to other agencies or partners, unless explicitly advertised at the time we request it. We may use this information to seek your views and opinions and carry our market research, analysis and reviews on East Coast FM and to inform you of any news concerning East Coast FM – this is generally (but not exclusively) done through our mailing list system. Unless you stipulate otherwise (or reactively unsubscribe) then we will add your email address to our database when you contact us and you will receive periodic emails in this way. Our mailing list is managed through MailChimp, an industry standard, secure service used by numerous companies throughout the world. More information can be found at mailchimp.com. If, at any time, you want to stop receiving emails, MailChimp provide an ‘unsubscribe’ option at the bottom of mail-shots.

  1. COMPETITIONS BROADCAST ON EASTCOASTFM OR MADE AVAILABLE ON ITS OFFICIAL ONLINE CHANNELS

The competition terms and conditions (the “Competition Terms and Conditions”) which can be found at  apply to all competitions broadcast on the radio station East Coast FM, which is a trading name of EastCoastFM (SCIO). (Competitions are individually referred to as “the Competition”.)

From time to time, individual competitions may have different or additional rules (referred to as the “Competition Rules”). In these instances, those rules will be published separately and made available alongside the terms and conditions. Any Competition Rules which alter the standard terms and conditions will automatically take precedence over, and supersede, any part of the Competition Terms and Conditions in the event of any contradiction or ambiguity.

Anyone who enters the Competition (a “Contestant”) will be deemed to have understood the Terms and Conditions and, where relevant, the Competition Rules and will be bound by them.

Copies of the Competition Terms and Conditions and, where applicable, Competition Rules are available online or on request by sending a stamped self addressed envelope to Competitions, East Coast FM, 2b Station Yards, Hospital Road, Haddington, EH41 3PP.   1. Make a contract with us

2.1 When you place an order with us, you are making an offer to buy goods. We will send you an e-mail to confirm that we have received your order.

2.2 In the unlikely event that the goods are no longer available, or that we have made a pricing mistake, we will advise you of this. You will not receive an e-mail confirming acceptance of your order, and there will be no contract between us.

2.3 Images of products on this website are for illustrative purposes only. Your goods may vary slightly from the image shown on the website and will not include any of the pictured accessories, unless stated in the specification of the goods. Whilst goods may be shown assembled they may require assembly by you.

2.4 We have made every effort to display as accurately as possible the colours of our products that appear on this website. However, we cannot guarantee that your monitor’s display of any colour will accurately reflect the colour of the actual goods.

2.5 Whilst we try to be as accurate as possible, all information provided is approximate and is provided in good faith.

  1. How to place order

3.1 You can use our website to place an order by selecting the product you wish to buy and adding it to your basket. Items you do not require can be removed from your basket at any time. If you prefer to order or make enquiries by telephone you can do so by calling 01620 826444.

3.2 If purchasing a quote, the buyer accepts full responsibility for checking the accuracy of that quote.

3.3 The buyer assumes responsibility for the goods being suitable for the purpose for which they are being purchased.

3.4 Carriage charges will be shown prior to you placing your order.

3.5 You will be required to pay for the goods in full at the time of ordering.

3.6 We use secure payment facilities for online purchases. You can pay for your order by Visa, Mastercard or Delta/Connect.

3.7 Any Promotional prices only apply during the period stated.

3.8 All prices quoted on our website are in UK pounds and include Value Added Tax at the current rate.

3.9 Once your order has been confirmed, changes may not be possible or may incur additional charges or delays.

3.10 Once your order is complete we will notify you of the dispatch date.

  1. Delivery & Carriage Charges

4.1 Goods will be dispatched within 5 working days and any estimated dispatch date is an estimate, which can change without notice. Dispatch may be delayed in accordance with point 4.13.

4.2 We will deliver goods within 2-3 working days of dispatch. Deliveries may be delayed in accordance with point 4.13.

4.3 Your order may arrive in more than one delivery.

4.4 We can deliver our products anywhere in mainland Great Britain and Republic of Ireland.

4.5 We will deliver the goods to the premises you specify on your order. You must be at home to accept delivery of your order, which is between 7:30am and 6:00pm Monday-Friday.

4.6 Disposal of any packing materials if applicable is your responsibility.

4.7 If there is no one to accept the order on the scheduled delivery date the goods may be returned to us and we reserve the right to charge you an additional re-delivery charge.

4.8 If you change the delivery address once the goods have been dispatched to you, we reserve the right to pass on any extra charges made by our carriers for redirecting your delivery, if the carriers are able to make the change. This will delay your delivery.

4.9 Please check the goods on delivery – any goods found to be missing or damaged should be notified to the delivery driver at the time of delivery or ourselves within two working days of delivery of the items.

4.10 If the goods are lost or damaged please report this to us within two working days from the delivery day.

4.11 Sometimes, for reasons beyond our control we may be prevented from delivering your goods as planned. These might include things such as accidents, breakdowns, fire, flood, storm, severe weather, acts of god, war, riot, civil commotion, malicious damage or the default of our suppliers. We are not responsible where this causes a delay or failure in delivering your goods.

 

  1. Cancellation and returns

5.1 This policy does not apply to goods ordered by businesses which are exempt from the Distance Selling Regulations, or the following goods which are exempt from the right to cancel.

For Trade and Business customers, please see section 8.

5.2 You can cancel your contract at any time up to 14 days after the day of delivery. To do this, please e-mail, or write to us. We are unable to accept cancellations by phone. Please refer to point 5.1 for items exempt from this term.

5.3 You do not have to give any reason for cancellation. However, a brief explanation will help us to improve the service we offer to customers in the future.

5.4 If you cancel, you must return the goods within 14 days of cancellation, complete with the original packaging to us and/or our supplier (or any other UK address specified by us), at your own expense. You must ensure that the goods are packaged adequately to protect against damage.

5.5 You may properly examine the goods for 14 days as you would do had you visited our premises, however you may not return any goods that have been used unless they are faulty. For exempt goods please see point 5.1.

5.6 If you fail to return the goods, we will collect them, and we will charge you the direct cost of collection. If you fail to take reasonable care of the goods before they are returned to us, and this results in damage or deterioration, we will charge you for the reduction in value.

5.7 We will refund all monies paid to us by you including any postage / carriage within 30 days, less any costs due under this contract. Please see point 5.1 for exemptions.

5.8 We reserve the right not to replace any item that has been used, as we will deem this acceptance of the goods.

5.9 We are not liable for any loss earnings due to late, incorrect or lost deliveries.

5.10 We reserve the right to refuse replacements on any damaged items reported to us outside of two working days. Please refer to points: 4.10 and 4.11.

This cancellation policy does not affect your legal rights – for example, if goods are faulty or misdescribed.

 

  1. Faulty Goods / Guarantee

6.1 If there is a problem with the goods, please notify us by email or in writing providing details of the problem. In addition, you must provide us with a digital photograph of the problem as this saves you having to return the goods for inspection. We will deal with the matter in accordance with your legal rights. Please see points 4.10 and 4.11 for time restrictions.

6.2 If an exchange is necessary, this will be arranged without unreasonable delay and without charge. Replacement goods will not be dispatched until either a indicative digital image is supplied by the customer, or the original goods have been received at our warehouse and checked.

The cost of returning goods to us is your responsibility, however on inspection we will refund your reasonable postage costs, providing that the goods are found to be faulty. If the goods are not faulty, we will return them to you, however you will be required to cover our reasonable postage costs.

6.3 If an item is no longer available we will offer an alternative. However, our liability will be to replace the faulty goods only and we are unable to guarantee an exact match. In this instance, you will have the option of a refund on the items under the warranty claim.

6.4 Where we replace faulty goods you are responsible for their disposal if they have not previously been returned to us.

6.5 We are unable to guarantee and exact colour match due to the nature of the product.

 

  1. Liability

7.1 The products sold on this website have been designed to comply with all relevant UK legislation. We cannot warrant or represent that they comply with any legal requirement outside the UK.

7.2 We do not accept liability for any consequential loss of profit or indirect losses. You should therefore not book installation of the goods until you have received them and inspected them.

  1. Trade or Business Customers

The following conditions apply to orders placed by Trade or Business Customers.

8.1 Orders may not be cancelled except with our mutual agreement and having been confirmed in writing by a Director of our company. We reserve the right to make cancellation and/or re-stocking charges.

8.2 Claims for missing or damaged items must be made in writing within 2 working days of delivery.

8.3 If purchasing a quote, the buyer accepts full responsibility for checking the accuracy of that quote.

8.4 The buyer assumes responsibility for the goods being suitable for the purpose for which they are purchased.
